  • Many people who currently receive subsidies may qualify for larger subsidies or many who didn't qualify because their income was too high may now possibly qualify for generous subsidies.
  • People who are receiving unemployment compensation at any point in 2021 will qualify for subsidies & CSR (Cost savings reductions) as if their income was 133% of FPL. This will end at the end of 2021.
  • These subsidies are retroactive to January 1, 2021.
  • People who were involuntarily terminated and offered COBRA will have their premiums covered FOR FREE until September 30, 2021.
  • These changes a recurrently approved for two years, and Congress will need to tke further action to keep then around for longer than that.

SEP Available for Individuals Affected by a Government Entity-Declared Disaster or Other Emergency: 

 Florida Announces a State of Emergency due to System Failures at EastPort Terminal Facility (Executive Order)

 

ATTENTION: Medicare Recipients in Hillsborough, Pinellas and Manatee Counties

CMS provides a Special Enrollment  Period (SEP) for individuals affected by a disaster or other emergency declared by a Federal, state or local government entity who were unable to, and did not make an election during another valid election period due to the emergency or major disaster. 

The SEP starts as of the date the declaration is made, the incident start date or, if different, the start date identified in the declaration, whichever is earlier. The SEP ends 2 full calendar months following the end date identified in the declaration or, if different, the date the end of the incident is announced, whichever is later.

 

An SEP is available in certain counties in Florida due to system failures at the EastPort Terminal Facility. 

 

Incident Period: April 3, 2021 - June 2, 2021

Counties: Hillsborough, Manatee, Pinellas

SEP End Date: August 31, 2021

Who qualifies for this special enrollment period?

This applies to individuals who:

  • Reside, or resided at the start of the SEP eligibility period, as described in this guidance, in an area for which a federal, state or local government entity has declared a disaster or other emergency or they do not reside in an affected area but rely on help making healthcare decisions from one or more individuals who reside in an affected area; and
  • Were eligible for another election period at the time of the SEP eligibility period; and
  • Did not make an election during that other valid election period due to the disaster or other emergency.

Update: Texas Severe Winter Storm (Executive Order)

  CMS provides a Special Enrollment  Period (SEP) for individuals affected by a disaster or other emergency declared by a Federal, state or local government entity who were unable to, and did not make an election during another valid election period due to the emergency or major disaster.

The SEP ends 2 full calendar months following the end date identified in the declaration or, if different, the date the end of the incident is announced, whichever is later.

 Here’s an update to the SEP available due to the Severe Winter Storm for the State of Texas.

 On February 12, 2021 the Governor of Texas issued a disaster proclamation for severe winter weather.  This declaration was renewed on April 16, 2021.

Counties: Entire State

SEP End Date: 6/30/2021

Who qualifies for this special enrollment period?

This applies to individuals who:

•             Were eligible for another election period at the time of the SEP eligibility period; and

•             Did not make an election during that other valid election period due to the disaster or other emergency.

What steps do Agents have to follow?

If an individual wants to enroll and believes they may qualify for this SEP, agents should:

•             Ask the beneficiary if they can show proof that they lived/live in an impacted area at the start of the SEP eligibility period. If they do not have proof, ask them to verbally attest.

•             Confirm that they had another election period available during the time of the incident period.

•             Confirm that the beneficiary lived in a county that has been declared a disaster or emergency by a federal, state or local government entity.

•             Once you’ve verified their eligibility, proceed with the application  and select these two enrollment reasons:

o             Affected by an emergency or major disaster (as declared by FEMA or a government entity)

o             Election period enrollee was eligible for and not able to use due to the declared disaster or emergency. Provide dates when applicable (e.g. change in residence)

The enrollment will be submitted to CMS using this election code.  If it is determined that this election is not appropriate, our Agent Support team will contact the agent to inform them, and the member will receive a Request for Information (RFI) to determine if another election period is available to them.

Please note that enrollments made using this SEP are effective the first of the month following the receipt of the enrollment request.
